Notice of Development of Rulemaking

Purpose: This rule is being established pursuant to s. 373.042 and 373.0421, F.S. The rulemaking will establish minimum flows and levels for the upper and middle reaches of the Suwannee River and their associated priority springs, including four Outstanding Florida Springs. This will have the potential to impact consumptive use applicants and permittees within the Suwannee River and St. Johns River Water Management Districts.

Purpose: By July 1, 2017, the District is required to set minimum flows or levels (MFLs) for Silver Springs in Marion County, an Outstanding Florida Spring. Based on the best available information, all three recommended minimum flows and levels in proposed 40C-8.031(7), F.A.C., are currently being achieved; however, the recommended minimum frequent low flow and level for Silver Springs would not be met under projected water use demands through the 20-year planning horizon. Thus, the District has concurrently approved an MFL prevention strategy to prevent the existing flows and levels from falling below the established minimum flows and levels. That strategy includes a regulatory component, consisting of new rules to prevent the existing flows and levels from falling below the minimum flows and levels for Silver Springs.

Purpose: The proposed revisions address paragraphs 403.0623(2)(a) and (b), Florida Statutes, enacted under Chapter 2016-01, Laws of Florida, which direct the department to establish quality assurance (QA) standards for the collection and analysis of water quantity data. The proposed revisions also: (1) update DEP field and laboratory Standard Operating Procedures (DEP SOPs), (2) address miscellaneous, minor revisions to various rules within the chapter, (3) generally provide for clarification, and (4) provide increased flexibility for approval of alternative methods.

Purpose: The purpose and effect of the proposed amendments to rules in Chapter 40C-2, F.A.C., will be to create any necessary prevention or recovery strategies, pursuant to subsection 373.0421(2), F.S., for one or more of the following Outstanding Florida Springs (OFS), as defined in subsection 373.802(4), F.S., for which the District is required by subsection 373.042(2), F.S., to adopt minimum flows or levels (MFLs) to protect: Alexander Springs in Lake County, Gemini Springs in Volusia County, Silver Glen Springs in Marion/Lake Counties, and Silver Springs in Marion County. Under paragraph 373.042(2)(a), F.S., those OFS MFLs (or emergency OFS MFLs) must be effective by July 1, 2017.

Full Text: The Petition was granted by the Governing Board of the South Florida Water Management District on March 9, 2017. The Order (Order No. 2017-018-DS-WU) is limited to the specific information set forth in the Petition and the City’s Consumptive Use Permit (“CUP” or “Permit”), CUP No. 06-00070-W. The District’s determination is limited to the City’s particular circumstances alleged in the Petition, not the conduct or responsibilities of the Federal Aviation Administration (“FAA”), the Pompano Beach Airpark (“Airpark”), or the City arising from purchase agreements, deeds, or other agreements between or among them. This Declaratory Statement specifically responds to the questions raised in the Petition as follows: a. A landowner does not have ownership and control of the water underlying its property solely by virtue of ownership of the overlying land. b. To obtain a CUP, an applicant must demonstrate compliance with the conditions and criteria enumerated in Section 373.223(1), Florida Statutes, Rule 40E-2.301, Florida Administrative Code, and the Applicant’s Handbook, including Sections 2.0 and 2.1. c. The only use of water authorized under the Pompano Beach Permit is for public water supply in the service area described in the Permit.
